These Terms of Service (“Terms”) govern your access to and use of MyTaxGPS, including our website, software, tools, reports, content, tax strategy workflows, and related services.
These Terms are a binding agreement between you and Wealth x Taxes, doing business as MyTaxGPS (“MyTaxGPS,” “we,” “us,” or “our”).
By accessing or using MyTaxGPS, you agree to these Terms. If you do not agree, you may not use the service.
1. Description of Service
MyTaxGPS is a software platform that helps users review tax-related information and identify potential tax strategy opportunities. The service may allow users to upload prior-year tax returns, answer intake questions, review tax-related data, generate strategy summaries, model estimated outcomes, and receive informational outputs.
MyTaxGPS is not tax filing software. MyTaxGPS does not prepare, sign, or file tax returns for you unless we separately agree in a signed written agreement.
2. Informational Purposes Only
MyTaxGPS provides informational and educational tools. The service does not provide tax, legal, accounting, investment, financial planning, or other professional advice.
Outputs generated by MyTaxGPS may include estimates, assumptions, summaries, potential strategies, calculations, or general observations. These outputs may be incomplete, inaccurate, outdated, or not applicable to your specific circumstances.
You are solely responsible for reviewing all information, verifying all outputs, and consulting a qualified tax, legal, accounting, or financial professional before making decisions or taking action.
3. No Professional-Client Relationship
Your use of MyTaxGPS does not create a CPA-client, attorney-client, financial advisor-client, fiduciary, tax preparer-client, or other professional relationship with us.
No professional relationship is created unless we enter into a separate written agreement that expressly states otherwise.
4. User Responsibility for Results
You are solely responsible for your tax, financial, legal, and business decisions.
You acknowledge and agree that:
- You are responsible for the accuracy, completeness, and legality of all information you provide.
- You are responsible for reviewing all outputs before relying on them.
- You are responsible for determining whether any strategy is appropriate for your facts and circumstances.
- You are responsible for complying with all applicable federal, state, local, and international laws.
- You are responsible for consulting qualified professionals before implementing any tax strategy.
- You are responsible for the final results of any action or inaction based on the service.
MyTaxGPS does not guarantee tax savings, refund amounts, audit outcomes, compliance outcomes, financial results, or any particular tax treatment.
5. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use MyTaxGPS.
If you use MyTaxGPS on behalf of a business, trust, estate, entity, household, or another person, you represent that you have authority to provide information and use the service on their behalf.
6. Accounts and Credentials
You may need to create an account to use certain features. You agree to provide accurate and complete account information and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately if you believe your account has been compromised.
We are not responsible for losses caused by unauthorized account access resulting from your failure to safeguard your credentials.
7. Uploaded Documents and User Content
You may upload tax returns, tax forms, financial documents, business records, and other materials to the service (“User Content”).
You retain ownership of your User Content. By uploading or submitting User Content, you grant MyTaxGPS a limited license to host, store, process, analyze, display, transmit, and use the User Content as necessary to provide, maintain, secure, and improve the service.
You represent and warrant that:
- You have the right to upload and provide the User Content.
- The User Content is accurate to the best of your knowledge.
- Your use of the service does not violate any law, contract, duty, or third-party right.
- You will not upload malicious code, unlawful content, or content that infringes another party’s rights.
8. Tax Return and Financial Information
You understand that tax returns and financial records may contain sensitive information. You should not upload documents unless you are comfortable providing them to MyTaxGPS for processing under our Privacy Policy.
You are responsible for removing or redacting information that you do not want processed, unless the information is necessary for the service.
We may rely on the information you provide without independently verifying it.
9. AI, Automation, and Software Limitations
MyTaxGPS may use automated systems, artificial intelligence, machine learning, rule-based logic, third-party tools, or other software methods to process information and generate outputs.
You understand that automated systems can make mistakes. Outputs may be affected by incomplete uploads, inaccurate source documents, missing facts, tax law changes, interpretation issues, software limitations, or assumptions made by the platform.
You agree not to treat any output as a substitute for professional judgment.
10. No Guarantee of Accuracy or Savings
We strive to provide useful software and information, but we do not guarantee that:
- The service will identify every available tax strategy.
- Any strategy will be available, appropriate, or beneficial to you.
- Any calculation or estimate will be accurate.
- Any output will be accepted by the IRS, any state tax authority, a court, lender, investor, or other third party.
- Your use of the service will reduce taxes, increase refunds, prevent audits, or produce any particular financial result.
All outputs are provided “as is” and should be independently reviewed.
11. Prohibited Uses
You agree not to:
- Use the service for unlawful, fraudulent, deceptive, or abusive purposes.
- Upload false, misleading, unauthorized, infringing, or unlawful content.
- Use the service to evade taxes, hide income, commit fraud, or violate tax laws.
- Reverse engineer, copy, scrape, resell, or exploit the service.
- Interfere with the security or operation of the service.
- Attempt unauthorized access to any account, system, or data.
- Use the service to develop a competing product without our written permission.
- Misrepresent outputs as professional advice or official tax determinations.
12. Third-Party Services
The service may rely on or integrate with third-party providers, including cloud hosting, analytics, payment processing, document processing, communications, or AI technology providers.
We are not responsible for third-party services, and your use of third-party services may be subject to their own terms and privacy policies.
13. Fees and Payment
If MyTaxGPS offers paid features, you agree to pay all applicable fees shown at the time of purchase.
Fees are non-refundable unless otherwise stated in writing or required by law.
We may change pricing, features, or billing terms prospectively. Continued use of paid features after changes become effective constitutes acceptance of the updated pricing or terms.
14. Intellectual Property
MyTaxGPS, including the software, workflows, designs, text, graphics, reports, templates, algorithms, logic, trademarks, and other materials, is owned by us or our licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the service for your personal or internal business purposes.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the service except as expressly permitted by us in writing.
15. Feedback
If you provide feedback, suggestions, ideas, or recommendations, you grant us the right to use them without restriction or compensation to you.
16. Suspension and Termination
We may suspend or terminate your access to the service at any time if we believe you have violated these Terms, created risk for us or others, failed to pay fees, misused the service, or violated applicable law.
You may stop using the service at any time. Termination does not affect rights or obligations that accrued before termination.
17. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTAXGPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, CURRENT, OR FREE FROM ERRORS.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTAXGPS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, LOST DATA, BUSINESS INTERRUPTION, TAX PENALTIES, INTEREST, AUDIT COSTS, PROFESSIONAL FEES, OR OTHER LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO MYTAXGPS FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
19. Indemnification
You agree to defend, indemnify, and hold harmless MyTaxGPS and its owners, officers, employees, contractors, affiliates, service providers, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use of the service.
- Your User Content.
- Your violation of these Terms.
- Your violation of law.
- Your tax, legal, financial, or business decisions.
- Your implementation of any strategy or output.
20. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
21. Dispute Resolution and Venue
Before filing a claim, you agree to first contact us at [legal@mytaxgps.com] and attempt to resolve the dispute informally.
If a dispute cannot be resolved informally, any legal action arising from or related to these Terms or the service will be brought in the state or federal courts located in [County], Texas, unless applicable law requires otherwise.
You consent to personal jurisdiction and venue in those courts.
22. Changes to the Service
We may modify, suspend, discontinue, or restrict access to any part of the service at any time, with or without notice.
We are not liable for any modification, suspension, or discontinuation of the service.
23. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above.
If changes are material, we may provide additional notice. Your continued use of the service after updated Terms become effective means you accept the updated Terms.
